Welcome to ShotSnap!

These Terms of Service ("Terms," "Agreement") govern your access to and use of the ShotSnap desktop application ("App," "Service," or "Software") operated by ShotSnap ("we," "us," or "our").

By downloading, installing, or using ShotSnap, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. License and Use

1.1 License Grant

We grant you a personal, limited, non-exclusive, non-transferable license to install and use ShotSnap on your device for personal or business use, in accordance with these Terms.

1.2 Restrictions

You agree not to:

• Copy, modify, reverse-engineer, or redistribute the app.
• Use the app for any unlawful purpose.
• Attempt to access, modify, or interfere with our services or third-party APIs.
• Use the app to generate or transmit harmful, misleading, or illegal content.

Violation of these rules may result in termination of your license.

2. Subscriptions and Payments

2.1 Billing

ShotSnap offers free and paid subscription plans. All paid subscriptions are billed securely through Stripe.

By subscribing, you authorize ShotSnap (through Stripe) to charge your payment method on a recurring basis (monthly or annually, depending on your plan).

2.2 Renewal and Cancellation

Your subscription will automatically renew at the end of each billing cycle unless canceled. You may cancel at any time through your account or by contacting us at billing@shotsnap.ai.

Access to premium features will continue until the end of the current billing period — cancellations take effect on the next cycle.

2.3 Refunds

All sales are final. Because ShotSnap provides digital software access, we do not offer refunds after a subscription has been activated or renewed.

Exceptions may be granted in rare cases of billing errors or system faults.

3. Data and Privacy

Your privacy is extremely important to us. Our Privacy Policy describes how we collect, use, and protect information when you use ShotSnap.

By using the app, you agree to our Privacy Policy.

• We only collect name and email for subscriptions.
• Screenshots and AI prompts are not stored by us.
• Payments are processed securely via Stripe.
• Anonymous analytics are collected via Aptabase to improve performance.

4. AI Content and Accuracy Disclaimer

ShotSnap uses the OpenAI API to process screenshots and generate responses.

By using AI features, you acknowledge and agree that:

• The AI's responses are automatically generated and may contain errors, inaccuracies, or hallucinations.
• You are solely responsible for how you interpret or use the results.
• ShotSnap does not guarantee the accuracy, completeness, or suitability of AI-generated content for any purpose.

We are not liable for any damages, losses, or consequences arising from reliance on AI responses.

5. Intellectual Property

ShotSnap, including its name, logo, and software code, are owned by ShotSnap and protected by intellectual property laws.

You retain ownership of your screenshots and any content you process through the app. However, you grant us a temporary, limited license to transmit data to OpenAI's API solely for the purpose of providing AI responses.

You may not reproduce, distribute, or create derivative works of ShotSnap without our written permission.

6. Software Updates and Availability

We may release updates, patches, or new versions of the app from time to time. Some updates may install automatically.

We reserve the right to modify, suspend, or discontinue any feature of the app at any time without notice.

We make reasonable efforts to maintain availability but do not guarantee uninterrupted or error-free operation.

7. Termination

We may suspend or terminate your access to ShotSnap immediately, without prior notice, if:

• You breach these Terms.
• You use the app for illegal or harmful purposes.
• Required by law or third-party API policy changes.

Upon termination, your right to use the app ends immediately. Sections relating to Liability, Intellectual Property, and Disclaimers will survive termination.

8. Limitation of Liability

To the maximum extent permitted by law:

• ShotSnap and its affiliates, partners, or licensors will not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, profits, or goodwill.
• Our total liability for any claim related to the Service shall not exceed the total amount paid by you for the subscription in the 12 months preceding the claim.

Use of the app is at your own risk.

9. Disclaimer of Warranties

ShotSnap is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

• The app's performance or reliability.
• The accuracy of AI-generated outputs.
• Compatibility with your device or operating system.

You assume full responsibility for using ShotSnap.

10. Indemnification

You agree to indemnify and hold harmless ShotSnap, its affiliates, and employees from any claims, damages, or expenses arising from your misuse of the app or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Oklahoma, United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oklahoma.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version and update the "Effective Date" above.

Your continued use of ShotSnap after such updates means you accept the revised Terms.
